1. Description of Service

Filmate.ai is an AI-powered short-form talking head video editor. Users can upload videos, and our platform automatically edits them using advanced AI techniques.

2. Eligibility

You must be at least 13 years old to use Filmate.ai, or 16 years old in jurisdictions (such as the European Union and United Kingdom) where applicable law sets a higher minimum age for consent to data processing. You are responsible for your account and for ensuring your use complies with all applicable laws.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate information and keep your login credentials secure.

4. Subscription Plans & Billing

We offer monthly subscription plans:

• Basic ($29/month): 20 videos/month, customizable captions, auto-positioning, text-based trimming, AI-generated hooks, 1080p export.
• Standard ($49/month): 40 videos/month. Includes everything in Basic plus auto sentence emphasis, custom backgrounds, zoom effects, entity search, transitions, and background music, Custom B-rolls with auto search and 15 B-roll uploads.
• Pro ($69/month): 80 videos/month. Includes everything in Standard plus custom B-rolls with AI-powered search, Up to 30 B-roll uploads, Priority support.

We also offer 1 free video edit per user. All payments are securely processed by Paddle.com. Subscriptions renew automatically each billing cycle until cancelled.

5. Refunds & Cancellation

All purchases are final and non-refundable, except where required by applicable law. Please try the free edit before purchasing a plan.

If you are located in the European Union or United Kingdom, you acknowledge that our Service constitutes digital content and/or a digital service that is fully performed once your videos begin processing, and that by choosing to access and use the Service immediately after purchase you expressly consent to such performance and waive your statutory right of withdrawal under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and equivalent UK regulations, to the extent permitted by law.

You may cancel your subscription at any time before your next renewal date to avoid being charged for the following billing cycle. Cancellation stops future billing but does not entitle you to a refund for the current or any prior billing period already paid.

6. User Content

By uploading videos, you grant Filmate.ai a limited license to process your content solely for the purpose of editing. This includes any B-roll or supplementary footage you upload — such uploads remain your content, and you represent that you own or otherwise have the necessary rights to use them. You retain ownership of your original media.

7. Biometric Data & Consent

Videos you upload may contain images of your face and recordings of your voice, which may constitute biometric identifiers or biometric information under certain state or national laws, including the Illinois Biometric Information Privacy Act and similar statutes. By uploading such content, you represent that you have the right to do so, including the consent of any other individual who appears or speaks in the video, and you expressly consent to Filmate.ai processing such biometric identifiers solely to provide the editing Service.

Filmate.ai does not sell, license, or otherwise disclose biometric identifiers to third parties, except where necessary to provide the Service (for example, cloud infrastructure used to process your videos) or as required by law. Filmate.ai retains biometric identifiers only for as long as necessary to provide the Service and will delete such data thereafter in accordance with our Privacy Policy.

8. Ownership of Output

You retain full ownership of the edited videos and other content produced using the Service ("Output"), to the extent the Output derives from content you uploaded and own. Filmate.ai claims no ownership rights over your Output. Filmate.ai does not guarantee the originality of AI-generated elements (such as auto-generated captions, hooks, or backgrounds), and you are responsible for ensuring your use of the Output complies with applicable law and third-party rights.

9. Intellectual Property

All technology, trademarks, and content on Filmate.ai are the property of the company or its licensors. You may not copy, reverse-engineer, or redistribute any part of the platform.

10. Account Termination

We reserve the right to suspend or terminate your access for violation of these Terms or misuse of our services.

11. Disclaimer

Filmate.ai is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees about specific outcomes or uninterrupted, error-free service. Use at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Filmate.ai, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Filmate.ai's total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount paid by you to Filmate.ai in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above limitations may not apply to you, and you may have additional rights.

13. Indemnification

You agree to indemnify, defend, and hold harmless Filmate.ai and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) content you upload, process, or distribute through the Service; (c) your violation of these Terms; or (d) your violation of any third-party right, including intellectual property, publicity, or privacy rights.

14. Governing Law

These Terms are governed by the laws of India. Any disputes will be resolved in accordance with Indian law.

15. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended. The seat of arbitration shall be Coimbatore, India. The arbitration shall be conducted by a sole arbitrator mutually appointed by both parties. The language of arbitration shall be English. The arbitrator's decision shall be final and binding.

You and Filmate each waive the right to participate in a class action lawsuit or class-wide arbitration. All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

For users outside India, disputes may be resolved through arbitration under the UNCITRAL Arbitration Rules, with the seat of arbitration in Coimbatore, India.

Nothing in this section limits any non-waivable statutory right you may have as a consumer under the mandatory laws of your country of residence.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by Filmate.ai, constitute the entire agreement between you and Filmate.ai concerning the Service and supersede all prior or contemporaneous agreements, representations, and understandings, whether written or oral.

18. Force Majeure

Filmate.ai shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet or utility failures, government action, or failures of third-party service providers or infrastructure.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Filmate.ai may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

20. Modifications

We may update these Terms at any time. Continued use of Filmate.ai after changes means you accept the revised Terms.
